Job Description

The University of Central Florida’s Office of Institutional Equity (OIE) seeks an Equal Employment Opportunity (EEO) Investigator to investigate complaints of violations of University policies and regulations based on discrimination, discriminatory harassment and retaliation. The successful candidate will act as an impartial, neutral investigator throughout all aspects of the investigation process, and ensure that all investigation activities and OIE decisions are consistent with University policies and procedures. The EEO investigator will conduct inquiries, perform investigations, provide University-wide training, facilitate employees’ requests for accommodations, and provide information to students and employees regarding compliance with the University’s nondiscrimination policies and regulations, as well as civil rights laws and regulations. The EEO investigator will report to the Director of the Office of Institutional Equity, and will be responsible for conducting prompt, thorough and impartial investigations, including preparation of concise and accurate investigative reports. At the direction of management, the EEO investigator also will assist in developing, implementing, and evaluating goals and objectives related to affirmative action and equal employment opportunity matters.

Duties and Responsibilities:
The EEO Investigator leads independent and unbiased employment discrimination investigations, and drafts investigative reports and recommendations for University leadership. This includes the following: perform intake of inquiries and complaints, and assess for an appropriate response; develop investigative plans; assess allegations to determine whether interim measures are required and if so, ensure the appropriate implementation of such measures; provide updates and advise parties, direct supervisors, and senior management on the investigation process; execute investigative plans by leading witness interviews, reviewing personnel files, supervisory files and disciplinary history of relevant parties, and gathering and reviewing relevant documentation; analyze statements and documentation to make credibility assessments and determine findings of fact; and, produce high quality investigative reports and recommendations. The EEO Investigator assists in maintaining OIE’s case database, and assists with preparation and maintenance of statistical, demographic, and subject matter data. The EEO Investigator facilitates the interactive process for employees’ requests for accommodations in the workplace. The EEO Investigator provides consultation, education and training to members of the University community regarding discrimination, harassment and/or retaliation concerns, and available resources for support and assistance in addressing and resolving concerns; and, works collaboratively with colleagues, committees, and campus partners to ensure civil rights compliance. The EEO Investigator assists management in the development and review of University-wide policies and procedures consistent with current law and policy concerning discrimination, affirmative action and diversity objectives; at the direction the OIE Director, serves as a liaison and representative to internal and external committees and professional associations; and, performs other duties as assigned by the OIE Director.

Minimum Qualifications

Master’s degree in an appropriate area of specialization; or a bachelor’s degree in an appropriate area of specialization and two years of appropriate experience.

Additional Minimum Requirements
Preferences

1. Prefer three years of recent and substantive work experience conducing employment-based discrimination and discriminatory harassment investigations or employment litigation.

2. Demonstrated ability to conduct thorough, efficient employment investigations.

3. Strong command and working knowledge of basic and advanced principles of federal and state nondiscrimination laws and employment discrimination, including but not limited to Title VI, Title VII, Title IX, and the Americans with Disabilities Act.

4. Resume reflecting demonstrated skill in witness examination/interview and investigation techniques, including leading effective party and witness interviews and producing high quality written work products.

5. Demonstrated ability to independently and efficiently manage a significant caseload.

6. Superb written and verbal communication skills and strong public speaking and presentation skills.

7. Strong work ethic and attention to detail; Highly motivated, self-directed execution of routine and special projects.

8. Strong interpersonal skills; Demonstrated ability to function well in both leader and teammate roles and interact with colleagues and superiors in a positive and constructive manner when faced with significant deadlines or workloads.

9. Demonstrated ability to exercise high level of discretion and good judgment, and ability to quickly establish credibility and productive working relationships with broad range of constituents, including administration, faculty, staff, student groups and unions.

10. Ability to maintain confidentiality.

11. Prefer five years of experience in conducting employment-based discrimination and discriminatory harassment investigations or employment litigation.

12. Experience working in a unionized environment.

13. J.D. with demonstrated employment litigation experience, and/or motion practice (particularly summary judgment motions).

14. Demonstrated ability to work constructively with diverse populations, and participation in, or support of, organizations that promote diversity or affirmative action.

15. Experience relative to Americans with Disabilities Act (ADA) compliance, including evaluation of requests for accommodations.

16. Experience working in a higher education environment or with higher education clients.
